Terms and Conditions

1. General 

1.1. In these terms and conditions and the Special Conditions (as defined below) (collectively referred to as the “Terms and Conditions”), "EZHomie" or “we” or “us” means EZHomie Technology Limited, and the "customer" or “you” means any person, firm, company or body which places an order with us. Please read these terms and conditions carefully before using the Website (collectively “our e-shop”). By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them. 

1.2. We shall make every effort to ensure that prices, details and sizes of products at our e-shop are up-to-date. Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and stock availability. 

1.3 . All photos and images of the products displayed in our e-shop are for illustration purposes in order to help you recognize the products only. The actual size, dimension and color of the products may differ. 

1.4. We shall make every effort to ensure product(s) displayed at our e-shop are in stock. If from time to time any products become out of stock, we reserve the right to offer alternative product(s) of similar value and style. 

1.5. All orders are subject to confirmation of final availability and we reserve the right to reject the order in the event that any of the products or services requested are unavailable. 

2. Member Registration 

2.1. You are required to first register as a EZHomie VIP and use your account logging into our e-shop in order to place order for products or services. Please visit EZHomie VIP website for further details. During the registration: 

2.1.1. You must provide us with accurate, complete and up to date registration information; 

2.1.2. You must safeguard your username and password; 

2.1.3. You authorize us to assume that any person using the e-shop with your username and password is either you or is authorized to act for you;;  

2.1.4. We have the absolute discretion to refuse registration of a potential customer and to terminate the registration of any customer for any reason whatsoever. 

2.2. You agree that you authorize EZHomie VIP Program to provide your relevant personal information to the Company on your behalf for the purposes set out under the Company’s Privacy Policy. 

 2.3 Please inform us immediately of any changes to the information that you provided via our Customer Service Department or by logging into your EZHomie VIP account profile so that we can communicate with you effectively.  

3. Changing Order/ Cancelation 

3.1. Placing an order means you agree to purchase products or services and appoint us to deliver the same on your behalf to your specified delivery address in accordance with these Terms and Conditions. After receiving your order, we will acknowledge receipt of your order. However, it is not an acceptance of your order. We reserve the right to reject any purchase order without giving any reasons. In the event that we are unable to accept your order (for example due to payment issue), we will notify the you. 

3.2. You confirm and agree that the information you provided is accurate and correct. If there are any delays in order processing or delivery delays occur due to incorrect data input by the customer, or if any consequences arise as a result, the company shall not be held responsible. 

3.3. In case any applicable gift items of your purchased products are not available, we will send another gift item to the customer.  

3.4 If the order cannot be conducted for any reason, including but not limited to out-of-stock or supply issues, we will refund the full amount to the customer. The refund amount will be made via the original payment method.  

3.5. Once your order is successfully accepted, the contract between the customer and us is thereby established and is subject to the terms and conditions. Customer shall, to the fullest extent permitted by the Applicable Law, neither cancel nor amend the order howsoever unless in accordance with these terms and conditions. 

3.6. We cannot guarantee any Products/Services shown on the website are available for sale at any time. If we cannot satisfy any order for any reason, we reserve the right to cancel the order and refund the amount (or part thereof) which you have paid to us and shall not be liable to you, or any person should we exercise such right. If any product in your order is not available, we will inform you accordingly. 

4. Payment 

4.1.  All product prices listed are in Hong Kong dollars. Customer can pay for orders at checkout in your local currency. By default, prices are converted automatically using the current market exchange rate, the applicable price of a product shall be the price listed in our e-shop as at the date of purchase.   

4.2. Acceptance of orders is subject to our sole discretion. A final record of purchase will be issued to you when goods are delivered to your address. 

4.3. To provide secure online transactions, we employ Internet's Transport Layer Security (TLS) technology. It encrypts your personal information, including credit card number, name and address, so that it would not be read as information travels over the Internet.  

4.4. You agree that your credit card payment shall be processed by the service providers engaged by us. You hereby acknowledge and agree that particulars of your credit card shall be passed to the relevant financial institution through such service providers. 

4.5. You agree to pay for every order made under customer account with the website by credit card and agree to indemnify us for any claims, losses, and damages whatsoever arising from the actions of any person placing any order for the products using your account with the Website or credit card. Customer shall be responsible for notifying the relevant financial institution of and be liable for any changes to your personal records, loss, theft or unauthorized use of your credit card. 

4.6. If you are a member of the EZHomie VIP Program, you may apply your EZPoints under customer account to redeem product (s) in our e-shop at the stated redemption rate if applicable. 

4.7. Title to the product shall remain vested in our company until our company has received full payment of the price and risk shall be passed to the customer upon delivery of the product. 

5. Hong Kong and Macau Delivery Service  

 5.1. You may enjoy standard delivery service to your specified billing address for each purchase within 3 KG .  

5.2. For certain products or those weighing over 3 KG, the customer will need to pay an additional fee to enjoy the delivery service. The delivery fee is subject to the product's weight, sizes, delivery addresses, and delivery quotas. The delivery fee will be calculated based on the actual weight per kg or volumetric (dimensional) weight to calculate the charge, opting for whichever is greater. In this case, the delivery fee will be quoted separately. 

5.3. Any delivery from our Website is using local express service. 

5.4. Macau delivery service is available at addresses located in Macau. 

5.5. Hong Kong delivery service is only available at addresses located in Hong Kong Island, Kowloon, New Territories, Tung Chung, Discovery Bay and Ma Wan. We currently offer selected delivery services to the following areas:  

  1. Tenement buildings / buildings without elevators: Depends on whether there is sufficient space on the staircase to carry the items upstairs. 
  1. Villages: Only to village entrance or legal car park entrance. 
  1. Government and public institutions: Only to the lobby or entrance area 
  1. Hotels: Only to the lobby  
  1. Restaurants: Only to the reception 
  1. Funeral Parlours: Only to the entrance area 

5.6. Delivery service is not available at non-permanent address, frontier closed areas, outlying islands, warehouses and premises which are not accessible by elevator or staircase and need to be delivered through balcony. 

5.7. Additional charges may apply and charge customers directly (applicable to large item delivery services in Hong Kong. 

5.7.1. Additional delivery fee for delivery to Tung Chung, Ma Wan, Park Island, Discovery Bay, and Lantau Island. 

5.7.2. If staircase is involved in delivery process, there will be extra handling cost incurred and customers will pay such extra fee to the delivery person directly. 

5.7.3. If the delivery address is more than 50 meters from the car drop-off point and extra manual lifting is incurred, there will be extra handling cost incurred. 

5.7.4. The customer must pay the additional moving fees directly to the driver on-site. If the customer refuses to pay the moving fees, the driver has the right to refuse the delivery and take away the goods. If the customer wishes to reschedule the delivery and moving, the customer will be responsible for all costs incurred. 

5.8. If you fail to receive your order due to missing the initial agreed delivery appointment or providing an incorrect address, we reserve the right to charge an additional delivery fee for subsequent delivery(es). 

5.9.* Normally, the product will be shipped within 7 working days when the your order is accepted, and payment is confirmed. However, delivery service on Saturday, Sunday and Public Holiday will be suspended and postponed to the next working day. Delivery time may be affected by seasonal holidays (i.e. Christmas, Chinese New Year, and Easter) or in the situation of overwhelming orders. Delivery will be delayed if a typhoon signal No.8 is raised or a black rainstorm warning is in effect. 
* We will dispatch the deliveries as scheduled to the best of our ability. 

5.10. All expected delivery dates and time are estimates only. We shall not be liable for any loss or damage incurred or suffered by the customer as a result of any late delivery. 

5.11. For any ordered goods remain undelivered or uncollected for 30 days from the date of order confirmation, we shall have the right to dispose of such goods at our own discretion without further notice to customer.  In such event, we shall not be liable to make any refund or compensation to customer. We also reserve the right to require the customer to pay an additional storage fee. 

5.12. In case of any dispute, our determination shall be final.  

6. Exchange Policy 

6.1. All items sold are not returnable or refundable. 

6.2. We accept an exchange only if the product that customer ordered are faulty, defective, or damaged (through no fault of customer's), or the product is not what customer ordered, or the quantity delivered is incorrect, exchange request may be made within 7 days after the delivery date. Request for return or exchange within (7) days, #provided that: 

6.2.1. The Product(s) must not be opened or used; 

6.2.2. All parts, accessories, user manual, free gifts, redeemed items are intact and returned together with the product(s);  

6.2.3. The packaging of the product (s) must be in the same condition as when it was delivered to customer; 

6.2.4. The original invoice must be presented; 

6.2.5. All products are only allowed to be exchanged or returned once per each order; 

6.2.6. Requests for exchange should be sent to our customer service department (contactus@ez-homie.com) via email (including transaction number, the reason for return or exchange, and product photo/video details) within 7 days. 

# Otherwise we will have the right to refuse the exchange application if the customer fails to complete and return the required documents or items. 

6.3. Please note that we only accept exchanges by SF Express and mail to our designated address. The cost of postage is borne by customer.  

6.4. We will check and verify the returned items before processing an exchange. If we find that the items do not meet the above exchange criteria, no exchanges will be made. When exchanging goods, the postage costs and handling fees (if applicable) for the returned goods will be borne by the customer. We apologize for any inconvenience caused. For all matters related to the exchange process, we reserve the final decision rights. 

6.5. Otherwise, under normal circumstances, we do not accept any requests for exchanges or order cancellations. 

7. Warranty  

7.1. EZHomie Technology Limited provides a period of one year warranty for our products (hereinafter called “Service”), commencing the date of purchase as stated on the Invoice / the date of delivery based on the terms and conditions set forth hereunder: 

7.2. By successfully registering products which is sold by EZHomie and becoming EZHomie VIP from https://ez-homie.com within 14 days, customer will be entitled to the warranty, provided that the original proof of purchase document must be presented upon the request of EZHomie, when Service is required. Such proof of purchase document must be an original receipt / invoice, containing the name of the dealer, the name of the product model and the purchase date. Service is only applicable to products purchased from EZHomie e-shop and/ or its authorized dealers in Hong Kong and Macau Special Administrative Region. Service does not apply to parallel import products. 

7.3. The product, subject to the warranty period and normal use, will be entitled to carry-in hardware repair service and replacements of parts (on-site hardware repair service will only be provided for selective models in Hong Kong), excluding power cables, signal cables, battery, consumable items, lost parts and those are over the lifetime. “Normal usage and maintenance conditions” refers to the installation, use, maintenance, storage, and transportation of the product that complies with the requirements of the user manual and is used for reasonable and expected purposes or uses. 

7.4. Unless stated in advance or required by law or agreement, Service will not be provided for items outside the scope of Service. 

7.5. The warranty is valid in Hong Kong SAR and Macau SAR only. 

7.6. Customers must send the product along with its accompanying items and packaging to our designated repair center for maintenance services. The shipping fee with be borne by the customer. If the same model or specification of the product or accessory has been discontinued, a replacement product or accessory with performance not lower than that of the original will be provided. 

7.7. The warranty does not cover: 

7.7.1. Periodical checking and replacing consumable items. 

7.7.2. Installation, dismantling, to transport, to disposal, removal or reinstate of any fittings and facilities which impede for repair service, 

7.7.3. Cleaning, dirt removal, disinsection, cleaning service. 

7.7.4. Replace, repair or recondition on the cabinet, chassis, panel, power cable, knob, external signaling system, remote controller, batteries, other accessories and exterior equipment of the product. 

7.7.5. Resolve any problems caused by computer virus and software or hardware connection errors. 

7.8. The warranty will automatically be deemed to be void if; 

  1. The product has been damaged due to misuse, abuse, negligence, physical damage, abnormal voltage supply/power interruption, accident, fire, flood, insect, natural calamities or other events beyond EZHomie control. 
  1. Non-genuine EZHomie consumable items such as mops or destinated SD card are used with the product. 
  1. The serial number sticker in the product has been modified or torn off. 
  1. Damage(s) was caused by force majeure. 

7.9. All Service will be conducted in EZHomie. 

7.10. Any defected parts, which have been replaced, shall become EZHomie’s property. 

7.11. The warranty period for products repaired or replaced during the warranty period will not be extended or renewed. 

7.12. Special conditions - Includes display and touch panel 

7.12.1. The below conditions are only applicable to EZHomie’s products with display or touch panel 

7.12.2. The warranty does not cover the weakness in brightness, depreciation of the optical engine of projectors, decline of image quality and less than or equal to 3 defective pixels in standard warranty period. 

7.12.3. If products are equipped with LCD or touch panel has 3 or more defective pixels, it will be deemed as defective by EZHomie and is replaceable upon request within the warranty period. However, the display must be under normal use and without any physical damage. 

7.13. EZHomie shall not be responsible or liable for any loss, damage, liability, including but not limited to any loss of or damage to data or software caused by any act, omission or negligence of any technician, employee or independent contractor or any circumstances that are beyond EZHomie’s reasonable control, including but not limited to any events of force majeure.  

7.14. In the event of any uncertainty or dispute, EZHomie has the sole and final decision and discretion of interpretation of the warranty terms and conditions hereunder. 

7.15. EZHomie reserves the right to unilaterally change the warranty terms and conditions from time to time without notice. 

7.16. Customer agrees and acknowledges that all personal information and documentation provided to EZHomie will only be used and retained by EZHomie for the purposes of performing repair service and enforcing the terms and conditions hereunder. Customer acknowledges that all its personal information and documentation provided to EZHomie are accurate and it is allowed to make corrections via EZHomie’s Customer Department’s email if any such personal information and documentation is no longer accurate. 

8. Privacy  

8.1. We are committed to safeguarding the privacy of individuals with respect to personal data. We therefore make sure that our policies and practices in relation to the collection, use, retention, transfer and access of personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486) under the laws of Hong Kong. Please refer to our Privacy Policy Statement . 

9. Others 

9.1. Basis of supply: we only serve and deliver products to end consumers. We are not selling our products for re-sell purpose. If we have grounds to believe that you are not purchasing our products as an end user, we reserve the right to decline or cancel your order.  

9.2. Force majeure: We shall not be liable for any delay or failure to perform caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failures, or any other causes beyond our control.  

9.3. You shall not assign, transfer or otherwise any of your rights and obligations under these Terms and Conditions to any other third party without our prior written consent. 

9.4. If any provision of these Terms and Conditions shall be construed to be illegal or invalid, they shall be removed from these terms and it shall not affect the legality, validity and enforceability of the other provisions of these Terms and Conditions.  

9.5. These Terms and Conditions embody the entire agreement between the parties and they supersede all previous negotiations, representations and agreement between the parties.  

9.6. We have the right, at any time, or from time to time, by giving prior notice to you, to modify or vary or supplement all or any of the provisions under these Terms and Conditions.  

9.7. If any dispute arises, our determination shall be final.  

9.8. These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region, the People's Republic of China and the Customer and we agree to submit to the exclusive jurisdiction of the Hong Kong courts. We may revise the Terms and Conditions at any time without prior notice.

Where these Terms and Conditions are available in both English and Chinese, the Chinese version is the governing version and shall prevail whenever there is a discrepancy between the two versions
